This End User License Agreement (“Agreement”) is a legal agreement between you (“User”) and NickSaintJohn (“Creator”), not with Apple. By using the EveryBuddy mobile application (“App”), User agrees to be bound by the terms of this Agreement. The Creator, not Apple, is solely responsible for the App and its content.
1. Scope of License: The license granted to the User for the App is limited to a non-transferable license to use the App on any Apple-branded products that the User owns or controls and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
2. Use of App: The App is provided for entertainment purposes only. The App is not to be used for any illegal or immoral activities. All information provided through the App is generated by ChatGPT, and the Creator is not responsible for the accuracy or reliability of such information.
3. Maintenance and Support: The Creator is solely responsible for providing any maintenance and support services with respect to the App, as specified in the EULA, or as required under applicable law. The User acknowledges that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
4. Warranty: The Creator is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, the User may notify Apple, and Apple will refund the purchase price for the App to the User. Beyond this, Apple has no other warranty obligation whatsoever with respect to the App.
5. Product Claims: The User acknowledges that the Creator, not Apple, is responsible for addressing any claims of the User or any third party relating to the App or the user’s possession and/or use of the App.
6. Intellectual Property Rights: In the event of any third party claim that the App or the User’s possession and use of the App infringes that third party’s intellectual property rights, the User acknowledges that the Creator, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
7. Legal Compliance: The User represents and warrants that (i) he/she is not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) he/she is not listed on any U.S. Government list of prohibited or restricted parties.
8. Developer Contact: Any End-User questions, complaints, or claims with respect to the App should be directed via email, to everybuddy@nicksaintjohn.com.
9. Third Party Terms of Agreement: The User agrees to comply with applicable third party terms of agreement when using the App.
10. Third Party Beneficiary: The User acknowledges and agrees that Apple and Apple’s subsidiaries are third party beneficiaries of this Agreement, and that, upon the User’s acceptance of the terms and conditions of the Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce the Agreement against the User as a third party beneficiary thereof.
By using the App, the User acknowledges that they have read and understood this Agreement, and agree to be bound by its terms and conditions.
